By accessing and using Reachly ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

2. Description of Service

Reachly provides a bulk SMS messaging platform that allows users to send text messages to multiple recipients. The Service includes contact management, message templates, scheduling, and analytics features. We utilize third-party services (including Twilio) to deliver messages.

3. User Responsibilities

As a user of Reachly, you agree to:

  • Obtain proper consent from all recipients before sending SMS messages
  • Comply with all applicable laws, including the Telephone Consumer Protection Act (TCPA)
  • Not send spam, fraudulent, or misleading messages
  • Not use the Service for illegal or harmful purposes
  • Maintain the security of your account credentials
  • Provide accurate and complete registration information

4. Prohibited Content

You may not use Reachly to send messages that:

  • Contain illegal content or promote illegal activities
  • Are harassing, threatening, or defamatory
  • Infringe on intellectual property rights
  • Contain malware or phishing attempts
  • Violate privacy rights of individuals
  • Are unsolicited commercial messages (spam)

5. Subscription and Billing

Reachly offers various subscription plans with different message limits. Subscriptions are billed monthly and renew automatically unless cancelled. Message limits reset at the beginning of each billing cycle. Unused messages do not roll over. Refunds are provided at our discretion and in accordance with applicable law.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. Message delivery depends on third-party carriers and may be affected by factors outside our control. We are not liable for delayed or failed message delivery.

7. Limitation of Liability

To the maximum extent permitted by law, Reachly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the preceding twelve months.

8. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease.
